Welcome to Dear Bestiee ("Dear Bestiee," "we," "us," or "our"). These Terms & Conditions ("Terms") govern your access to and use of the Dear Bestiee mobile application, website, and any related products and services (collectively, the "Service").

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you must not use the Service.

1. Eligibility

To use Dear Bestiee, you must:

• Be at least 18 years of age.
• Have the legal capacity to enter into a binding agreement.
• Provide accurate, complete, and up-to-date information during registration.

We reserve the right to suspend or permanently terminate any account if we reasonably believe the user does not meet these eligibility requirements.

2. About Dear Bestiee

Dear Bestiee is an emotional support and companionship platform that enables users to engage in thoughtful one-to-one conversations with a real person.

Dear Bestiee is designed to provide:

• Emotional support
• Friendly conversations
• A safe and respectful environment
• Meaningful companionship

Dear Bestiee is not:

• A mental health service
• A counselling service
• A psychotherapy service
• A healthcare provider
• A medical advice service
• A legal advice service
• An emergency or crisis response service

3. Not a Substitute for Professional Care

The Service is not intended to replace professional medical, psychological, psychiatric, legal, or financial advice.

If you are experiencing:

• A medical emergency
• Thoughts of suicide or self-harm
• Abuse or immediate danger
• A mental health crisis

you should immediately contact your local emergency services, a qualified healthcare professional, or an appropriate crisis support service in your country.

4. Account Registration

Certain features of the Service require you to create an account.

When creating an account, you agree to:

• Provide accurate information.
• Verify your email address when requested.
• Keep your login credentials confidential.
• Notify us promptly of any unauthorised access to your account.

You are responsible for all activities that occur under your account.

5. Acceptable Use

You agree to use the Service responsibly and lawfully.

You must not:

6. Close Bestiee Circle Subscription

Dear Bestiee offers an optional recurring premium membership known as Close Bestiee Circle.

Membership benefits may include:

• Priority responses
• Extended conversations
• Exclusive member features
• Other benefits described within the app

Features may change over time as the Service evolves.

Billing

Subscription fees:

• Are displayed before purchase.
• Are billed in advance.
• Automatically renew unless cancelled before the next renewal date.
• Are processed through Apple App Store, Google Play, or other authorised payment providers where available.

Subscription pricing, billing cycles, and available features may vary by platform or region.

Cancellation

You may cancel your subscription at any time through the platform from which it was purchased. Cancellation prevents future renewals but does not automatically entitle you to a refund for previous subscription charges unless required by applicable law or granted by the payment provider.

7. One-Time Support

Dear Bestiee allows users to make optional one-time support contributions through supported payment platforms.

One-time support contributions:

• Are voluntary.
• Do not create a recurring subscription.
• Do not automatically grant membership to Close Bestiee Circle unless expressly stated at the time of purchase.
• Help support the continued development, maintenance, and operation of Dear Bestiee.

Available contribution amounts may vary depending on the platform or region.

8. Payments

Prices for subscriptions and one-time support contributions may vary based on:

• Country
• Currency
• Platform
• Applicable taxes

Where required, taxes may be added during checkout.

Payment processing is handled by Apple App Store, Google Play, or other authorised payment providers. Dear Bestiee does not collect or store your complete payment card information.

9. Refund Policy

Refund eligibility depends on:

• The platform through which the purchase was made.
• Applicable consumer protection laws.

Refund requests for purchases made through Apple App Store or Google Play must be submitted through the respective platform.

10. User Content

You retain ownership of any content you submit through the Service, including messages and profile information.

By submitting content, you grant Dear Bestiee a limited, non-exclusive licence to use, process, store, and display such content solely for the purpose of:

• Maintaining security
• Complying with legal obligations

You remain solely responsible for the content you submit.

Your use of the Service is governed by our Privacy Policy, which explains how we collect, use, store, and protect your personal information.

12. Intellectual Property

The Service, including its software, design, branding, logos, graphics, text, and other content, is owned by or licensed to Dear Bestiee and is protected by applicable intellectual property laws.

13. Licence to Use the Service

Subject to your compliance with these Terms, Dear Bestiee grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to download, install, access, and use the Service solely for your personal, non-commercial use.

This licence does not transfer ownership of the Service or any intellectual property rights to you.

Except as expressly permitted by applicable law, you must not:

• Copy, modify, adapt, or create derivative works of the Service.
• Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Service.
• Sell, lease, rent, sublicense, distribute, or commercially exploit the Service.
• Remove or alter any copyright, trademark, or proprietary notices.
• Use the Service in any manner that violates these Terms or applicable law.

This licence automatically terminates if your account is suspended or terminated or if you otherwise cease to comply with these Terms.

While we strive to provide a reliable service, we do not guarantee uninterrupted availability.

• Modify functionality
• Perform maintenance
• Temporarily suspend access
• Discontinue parts of the Service

without prior notice where reasonably necessary.

15. Suspension and Termination

We may suspend or terminate your account if:

• We reasonably suspect fraudulent or unlawful activity.
• We are required to do so by law.
• Continued access poses a security risk.
• We discontinue the Service.

You may stop using the Service at any time.

To the fullest extent permitted by applicable law, we disclaim all warranties, whether express or implied, including warranties relating to:

To the fullest extent permitted by applicable law, Dear Bestiee, its owners, employees, affiliates, licensors, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service.

Our total liability for any claim arising from your use of the Service shall not exceed the greater of:

• The total amount you paid to Dear Bestiee during the twelve (12) months immediately preceding the claim; or
• USD 100.

Some jurisdictions do not permit certain limitations of liability. In those jurisdictions, the above limitations apply only to the extent permitted by law.

18. Indemnification

You agree to indemnify and hold harmless Dear Bestiee, its owners, employees, affiliates, licensors, and partners from any claims, damages, liabilities, losses, costs, and expenses arising from:

• Your use of the Service.
• Your violation of these Terms.
• Your content.
• Your violation of any applicable law or the rights of another person.

19. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of India, without regard to its conflict of law principles.

Nothing in these Terms limits any mandatory consumer rights available under the laws of your country of residence.

20. Dispute Resolution

If you have any questions or concerns, we encourage you to contact us first so that we may attempt to resolve the matter informally.

Unless otherwise required by applicable law, any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.

Dear Bestiee is intended for users worldwide, except where prohibited by applicable laws or regulations.

You are responsible for ensuring that your use of the Service complies with the laws applicable in your jurisdiction.

22. Export Compliance

You agree not to use the Service in violation of any applicable export control, trade, or sanctions laws.

23. Electronic Communications

By using the Service, you consent to receive electronic communications from Dear Bestiee, including:

• Account notifications
• Security alerts
• Transaction confirmations
• Service announcements
• Legal notices

Where required by law, you may choose whether to receive marketing communications.

Your continued use of the Service after updated Terms become effective constitutes your acceptance of those revised Terms.

26. Entire Agreement

These Terms, together with our Privacy Policy and any additional policies referenced herein, constitute the entire agreement between you and Dear Bestiee regarding your use of the Service.
